GREENEVILLE, Tenn. — Sean Williams' child porn trial was delayed again Monday, this time to November. Meanwhile, there is still debate over evidence found in Williams’ car when he was arrested in North Carolina.
Williams' child porn trial was set for Oct. 22, but now both the prosecution and the defense are agreeing to move it to Nov. 12.
That decision comes because of a schedule conflict for Williams’ attorney, who has another October trial. It's a case that has been delayed several times already after Williams went through four other attorneys.
Meanwhile, prosecutors are now responding to the defense's assertion that hard drives allegedly including more than 100,000 child porn images can't be admitted at trial.
Those drives, according to court documents, were discovered in Williams’ car when he was stopped for suspected drug use in North Carolina last spring and arrested on an outstanding warrant.
The defense argues it was an illegal warrantless search, but prosecutors now say "the automobile exception" allowed officers to conduct a warrantless search because "narcotics and drug paraphernalia were in plain view,"
Their filing goes on to say, even "if the court were to find any violation of the law,” it wouldn't matter. They point to the "inevitable discovery" doctrine to argue the evidence would have been found no matter what.
That evidence, according to court documents, includes images and videos of Williams sexually abusing 64 different women and at least five children.
