Judge sentences Tyler Enix to life in prison with possibility of parole

The jury could not reach a decision on the sentence, so the judge declared a mistrial on that portion of the proceedings and set the sentence

A judge has sentenced a Knox County man convicted of killing his ex-wife to life in prison with the possibility of parole after 51 years.

Judge Sword declared a mistrial on the sentencing only and discharged the jury. After Tyler Enix serves 51 years in prison, there is a possibility of parole. He has served 2 of those years already.

Enix murdered Kimberly Enix in her home and then took their 2-year-old child with him to Ohio, where he was caught in October 2015.

A sentencing date on the especially aggravated robbery charge is set for Nov. 30. The state has said they will ask the judge to make those consecutive sentences.

A Knox County jury will consider Monday whether Tyler Enix should spend the rest of his life in prison without a chance for parole for killing his ex-wife.

Jurors in Knox County Criminal Court on Friday found Enix guilty of first-degree murder in Kimberly Enix's 2015 killing.

Because the prosecution is seeking to deny Enix a chance at parole, they must by law present proof to back their argument. The defense also is entitled to present its own proof to counter the state.

Monday's punishment phase is considered a mini-trial.

After both sides present proof, the jury will deliberate and come up with a decision.

Enix's trial began last week before Judge Steve Sword.

Enix murdered Kimberly Enix in her home and then took their 2-year-old child with him to Ohio, where he was caught.

PREVIOUS STORY: After a week of testimony, the jury decided on Friday, Sept. 29, that Tyler Enix is guilty of first-degree premeditated murder.

The jury also found him guilty of aggravated robbery. He was found not guilty of the three felony murder counts.

Enix, 38, faced first degree murder in the death of his ex-wife, Kimberly Enix, and kidnapping their 2-year-old daughter in October 2015. Kimberly was found stabbed to death in their Fountain City home.

Enix will spend at least 51 years in prison, according to Assistant District Attorney General Kevin Allen.

Sentencing is set for Monday at 9 a.m.

The medical examiner testified Kimberly had 47 stab wounds which included defensive wounds on her left hand and forearms.

The second full day of testimony started in the trial for Tyler Enix Wednesday.

In closing arguments this morning, attorneys focused on the murder charge.

The state argued Tyler Enix wanted to control his wife and that his texts with her leading up to her death show that.

The defense argued that the relationship between Kimberly and Tyler Enix was volatile and so Tyler Enix killed her out of passion and rage, not premeditated thought.

The jury could come back with a lesser charge than first degree murder, such as second degree or voluntary manslaughter.

If the jury convicts Tyler Enix of first degree murder, he could face life in prison without parole.

While the jury was deliberating, Judge Sword read a victim impact letter and said it was read in preparation if the jury were to convict Tyler on first degree murder so they could move right into sentencing.

The jury returned to the courtroom around 3:30 p.m. Friday to ask about the definition of "perpetration".
